Legal Services

Legal services are provided by an outside law firm. The attorneys of Gilmore & Monahan, P.C. have served as municipal counsel for Little Egg Harbor Township since January 1996. The law firm has represented dozens of public entity clients on state, county and local levels including municipalities, land use boards, school boards, and independent authorities.

Municipal counsel is responsible for providing specialized and general legal services to the Township Committee and staff. These services include rendering legal opinions on complex issues, preparing resolutions and ordinances, representing the municipality and employees in litigation matters, negotiating and reviewing contracts with vendors, and providing general advice affecting policy development and implementation.

Initial contact with Little Egg Harbor Township concerning most legal issues should be made through the Township Administrator's Office. The Township Administrator will discuss your matter with you, open a file if necessary, and refer the matter to Gilmore & Monahan. In many cases the Township Administrator may be able to answer your questions or provide you information that is responsive to your inquiry without having to refer you to municipal counsel. In order for us to properly monitor legal costs we ask that you not contact Gilmore & Monahan directly unless a file has been opened by the Township Administrator and you have been advised to contact municipal counsel directly.

Request Public Records from LEHT

A "Request for Public Records Form" is available at the Township Clerk's Office.

Some records will be immediately available during normal business hours. Some records will require time to compile and to make the copies requested, but will be normally available during normal business hours and within seven (7) business days. If any document or copy that has been requested is not a public record or cannot be provided within seven (7) business days, you will be provided with a response containing that information within the seven (7) business days period.

Some statutes provide for a different response time. For example, municipal lien searches will be provided within fifteen (15) calendar days after the request is received and the fee is paid.

In general:

1. Immediate access will normally be available for ordinances, resolutions, budgets, bills, vouchers contracts, collective bargaining agreements, employment contracts, and public employee salary and overtime information.

2. Minutes of public meetings will be generally available immediately after the minutes have been approved.

3. Records which are not readily available or which will require a search of records will be made available as soon as possible and the applicant will be provided an interim report within seven (7) business days indication the estimated time required to complete the search of records.

4. When a legal determination must be made whether records are "public records," the request will be reviewed by municipal counsel.

5. The term "public records" DOES NOT INCLUDE employee personnel files and records, Police Department investigation files and records, public assistance files and records, or other files and records which reveal personal, private or confidential information (e.g., medical information, social security numbers, disciplinary records) or which may be specifically exempted by law.
